Illinois Residents: HB5855 COULD Pass as soon as Jan 4th & How IT WILL Affect YOUR WORK AND TRANSFERS

Different versions of the bills have passed both Illinois House & Senate. Once reconciled to agree (highly likely) the bill will go the Governor for signature and become EFFECTIVE IMMEDIATELY. There are some changes to what is shown below, which are called out quite effectively in Maxson's blog. See their updates here.

Fellow Illinoisans: HB5855, the so-called "Assault Weapons Ban," (see below for full info) is widely considered by people who know a lot more than we do as likely to be passed in the lame duck session, which runs from Jan 4th to the 11th. Those people further believe that like the "safety act," it will likely be passed in the middle of the night and promptly signed by the governor. There is no grace period or grandfather clause, so the worst case scenario is: millions of law-abiding Illinois residents wake up Jan 5th as felons. We're not being drama mamas--read it for yourself, link below. Lots of ordinary folks think this can't happen—it will be immediately challenged in court, etc. That is true, but a temporary injunction will be up to an Illinois judge. And then another. And another. It took 30 days to temporarily block a similar measure in Oregon with the battle still ongoing. Many, including us, believe HB5855 is blatantly unconstitutional but that won't help anyone during the time the measure is Illinois law, if any. THIS WILL HAVE SIGNIFICANT IMPACT ON YOUR POSSESSIONS IN OUR SHOP if it is passed as currently written and rushed through as described above. Full info follows. PLEASE read & make arrangements for pickup of your items asap or they may be stuck here in limbo for a while.

BANNED “ACTIONS”

EFFECTIVE IMMEDIATELY when the bill is signed. “Manufacture, Possession, Delivery, Sale & Purchase …”
Let’s think this through together. HB5855 “makes unlawful the manufacture, possession, delivery, sale and purchase of assault weapons & high capacity magazines”” as defined in the bill. The MOMENT it is signed, we will NOT BE ALLOWED to “Deliver” banned items = handing an item over to our customer under any circumstances. These include:
• Items purchased from us or others prior to the ban. Purchase date is irrelevant; they must be physically transferred before bill is signed.
• Consignment items that will now be defined as “assault weapons” CANNOT be returned to their owners.
• Items in for Cerakote/gunsmithing that fit the definitions in HB5855 CANNOT be returned to their owners.

​There is NO GRANDFATHER CLAUSE in this bill.

BANNED ITEM DEFINITIONS "CHEAT SHEET"

RIFLES
Possession: FELONY
Any semi auto center fire rifle that can accept a detachable magazine (regardless of capacity) and 1 of the following 
• Folding / Telescoping Stock
• Pistol Grip / Thumbhole stock or similar
• Forward pistol grip
• Flash hider / threaded barrel
• Grenade launcher / flare launcher
Also any semi auto center fire rifle as described below
• Any semi auto center fire rifle with overall length less than 30 inches.
• Any semi auto center fire rifle with a fixed mag that can hold more than 10 rounds

PISTOLS
Posession: FELONY

Any semi auto center fire pistol that can accept a detachable magazine (regardless of capacity) and 1 of the
following
• Accept a detachable magazine outside of the pistol grip
• Has a shroud that encircles the barrel (partially or completely)
• Threaded barrel
• Second pistol grip
Also any semi auto center fire pistol as described below
• Any semi auto center fire with a fixed mag that can accept more than 10 rounds.

SHOTGUNS
Possession: FELONY

Any semi auto center fire shotgun that has both of the following attributes.
• Folding / Telescoping Stock
• Pistol Grip / Thumbhole stock or similar
Also any semi auto shotgun as described below
• Any semi auto that can accept a detachable magazine
• Any semi auto that has a revolving cylinder
• Any semi auto with a fixed mag that can accept more than 10 rounds

MAGAZINES
Possession: (1) Misdemeanor; (2 or more) FELONY
Transfer: FELONY

Regardless of relevance to any of the potentially banned items and regardless of caliber…
ANY Magazines that can hold or be readily converted to hold more than 10 rounds.

50 BMG
Rifle: FELONY Ammo: Misdemeanor

Any rifle chambered in .50 BMG & any .50 BMG cartridges

ASSAULT WEAPON ATTACHMENT
Possession: FELONY

Any device capable of being attached to a firearm designed for making or converting it into any of the banned firearms listed. (Example: you have a pump shotgun with an adjustable stock and integral rail that is not prohibited, but also have a detachable pistol grip laying around in a drawer, you will be guilty of a felony.)
